In short: In France, nicotine pouches have been banned since 1 April 2026. According to the French government, the ban applies not only to sales but also to purchase, possession, import and use. Anyone who buys pouches in Switzerland and takes them to France is breaking French law. In Switzerland, pouches remain legal for adults aged 18 and over.
For most people in Switzerland, daily life does not change. However, if you live in France and work in Geneva, Basel or the Jura, spend holidays in France or cross the border regularly, you should know the new rules. Here you will find the key facts, a Switzerland vs. France comparison and answers to the most common questions.
Are nicotine pouches banned in France?
Yes. The legal basis is Decree No. 2025-898 of 5 September 2025. It has been in force since 1 April 2026. The official French government website service-public.gouv.fr lists the following as prohibited: use, acquisition, possession, sale, import, offering and transfer of nicotine pouches.
Pouches are not the only products affected. The ban also covers other oral nicotine products without tobacco, such as nicotine beads, pellets, gums and liquids for ingestion. Exempt are chewing tobacco and smoking cessation medicines from pharmacies, such as nicotine gum.
What did the Conseil d'État decide?
A company in the industry challenged the decree. On 22 December 2025, the Conseil d'État, France's highest administrative court, partially suspended the decree in urgent proceedings. Only the ban on manufacturing, production and export was suspended. The reason: the deadline for manufacturers to adapt their production was too short.
Important for consumers: the ban on sale, possession, import and use is not affected. The French Ministry of Health has confirmed that it remains in force. Anyone who buys, possesses or imports pouches in France is therefore acting outside the law.

Can I take pouches from Switzerland to France as a cross-border commuter?
No. Importing nicotine pouches into France has been banned since 1 April 2026, even in small quantities for personal use. There is no duty-free allowance like there is for cigarettes. This applies to your commute as well as to the trip home after shopping.
Because Switzerland is not in the EU, French customs law also applies when you cross the border. French customs can seize prohibited goods. According to a Paris law firm, no court rulings against individual consumers have been published so far. You should not rely on this, however: the law provides for criminal penalties.
In practice, this means for cross-border commuters:
- Use pouches only in Switzerland and do not take them across the border.
- If you work in Switzerland, you can keep your supply at your workplace (if your employer allows it).
- For holidays in France: do not pack any cans in your luggage.
What applies to holidays and transit through France?
The ban applies throughout French territory. It makes no difference whether you stay overnight in France or just drive through on your way to Spain. Airports in France are included too. As soon as you set foot on French soil, French law applies.
For trips to other countries, it is worth checking the local rules. The EU is also discussing its own tax on nicotine pouches. You can find the latest status in our article on the EU tobacco tax on nicotine pouches.
Are nicotine-free pouches or chewing tobacco allowed in France?
The decree covers products that contain nicotine and no tobacco. According to its wording, nicotine-free pouches are not covered. Still, customs officers cannot tell at a glance what is inside a can. Keep nicotine-free products in their original packaging. Chewing tobacco is explicitly exempt. Tobacco snus, on the other hand, has not been allowed for sale in France for a long time.
What does the ban mean for buyers in French-speaking Switzerland?
For customers living in Switzerland, nothing changes. Nicotine pouches are legal and regulated in Switzerland and only available from age 18. Since 1 October 2024, the minimum age of 18 applies uniformly across Switzerland, including online sales. There is currently no legal limit on nicotine content per pouch in Switzerland. So pay attention to the strength in mg per pouch yourself.
