Age restriction (18+)
Persons under the age of 18 may not place orders on the website. If an anomaly, false information or misuse of our ordering function is suspected, Snustrend reserves the right to refuse or cancel orders.
1. Scope
These General Terms and Conditions (GTC) apply to all orders placed by consumers (B2C) via the Snustrend online shop at www.snustrend.com. A consumer is any natural person who concludes a legal transaction for predominantly private purposes.
2. Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding product presentation.
The contract is concluded as soon as the customer submits an order and Snustrend accepts it by sending an order confirmation by email or by dispatching the goods.
Snustrend reserves the right to refuse orders without giving reasons.
3. Product range and product information
All information on the goods (in particular descriptions, images, diagrams and prices) is non-binding. Changes, errors as well as typing, printing or calculation errors are reserved.
If a product is not available, the customer will be informed; any payments already made will be refunded in this case.
4. Prices and terms of payment
Unless stated otherwise, all prices are in Swiss francs (CHF) and include statutory VAT as well as any applicable customs/tobacco duties. In addition, the shipping costs shown during the ordering process are charged.
Shipping costs within Switzerland and Liechtenstein for orders up to CHF 59.99 are CHF 8.90 (Economy) or CHF 11.90 (Priority); for orders from CHF 60.00 they are CHF 4.90 (Economy) or CHF 8.90 (Priority). The shipping costs shown during the ordering process are authoritative.
Invoices are sent exclusively by email. Unless otherwise agreed, payment is due within 15 days of the invoice date.
Payment methods include in particular PayPal, TWINT and any other payment methods displayed in the shop. In individual cases, Snustrend may exclude certain payment methods or restrict new/existing customers to certain payment methods.
Snustrend reserves the right to adjust prices and shipping costs at any time and to withdraw from the contract in the event of typing, printing or calculation errors.
5. Payment service providers
Purchase on account (including instalment payment) is processed by CembraPay AG. The GTC and privacy policy of CembraPay AG apply.
If payment service providers are used, it may be necessary to transmit personal data to them for payment processing. Processing takes place within the framework of the respective terms of use and privacy policies of the payment service provider and the applicable data protection laws.
6. Shipping and delivery
If stock is available, orders are usually shipped within one working day (for orders placed by 2:00 pm). The stated delivery times are non-binding and may vary.
Delivery is made to the address provided by the customer. Partial deliveries are permitted insofar as this is reasonable for the customer.
Obvious transport damage must be reported immediately to the carrier and to Snustrend.
7. Cancellation by the customer (processing fee)
Cancellation by the customer is only possible as long as the order has not yet been shipped.
A processing fee of CHF 2.50 per cancellation is charged for every cancellation initiated by the customer.
Snustrend reserves the right to cancel orders for important reasons (e.g. doubts about age, payment problems, misuse).
8. Right of withdrawal and right of return
Consumers are generally entitled to a 14-day right of withdrawal for online transactions.
The right of withdrawal is excluded for snus, snuff and other tobacco products, as these may be products with a limited shelf life or perishable goods.
Returns are only possible for incorrectly delivered or damaged products. In this case, Snustrend must be contacted within 48 hours of receipt.
9. Retention of title
The goods delivered remain the property of Snustrend until full payment has been made. In the event of late payment, Snustrend is entitled to withdraw from the contract and reclaim the goods.
10. Intellectual property
Snustrend reserves all rights to the design, texts, graphics and content of the website. Copying is only permitted for the purpose of the ordering process. Any further use requires the prior consent of Snustrend.
11. Data protection
Snustrend processes personal data within the framework of the applicable data protection provisions (in particular Swiss data protection law). Customer data is used to process the order and for internal purposes.
Data is only passed on to third parties insofar as this is necessary for the performance of the contract (e.g. shipping service providers, payment providers). The customer has the right to information about the data stored about them.
12. Disclaimer
12.1 Content of the online offering
Snustrend assumes no liability for the topicality, correctness, completeness or quality of the information provided. Liability claims are excluded unless there is intent or gross negligence and insofar as permitted by law.
12.2 References and links
Snustrend is not liable for the content of external websites referred to directly or indirectly, provided that Snustrend has no influence on their content and has no knowledge of unlawful content.
12.3 Copyright and trademark law
All brands and trademarks mentioned are subject to the rights of their respective owners. Reproduction or use of content without consent is prohibited.
12.4 Misuse / legal guidelines on the sale of tobacco products
No one under the age of 18 may order on the website. By placing an order, the customer confirms that they are at least 18 years old and will not resell any tobacco products. If a violation or misuse is suspected, Snustrend may refuse to execute the order.
13. Applicable law and place of jurisdiction
These GTC and contracts based on them are subject to Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction is St. Gallen, insofar as permitted by law.
14. Final provisions
The version of the GTC valid at the time of the order applies. Deviating conditions of the customer do not apply unless Snustrend expressly agrees to their validity in writing.
Snustrend reserves the right to amend these GTC at any time.
Should individual provisions be or become invalid, the validity of the remaining provisions shall remain unaffected.
