Age Restriction (18+)

Persons under the age of 18 are not allowed to place an order on the website. In case of suspicion of an anomaly, false information, or misuse of our ordering function, Snustrend reserves the right to refuse or cancel orders.

1. Scope

These General Terms and Conditions (GTC) apply to all orders placed by consumers (B2C) through the Snustrend online shop at www.snustrend.com. A consumer is any natural person who enters into a legal transaction for predominantly private purposes.

2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an informal product presentation.

The contract is concluded as soon as the customer submits an order and Snustrend accepts it by sending an order confirmation via email or by shipping the goods.

Snustrend reserves the right to refuse orders without providing reasons.

3. Product Offer and Product Information

All information regarding the goods (especially descriptions, images, diagrams, and price information) is non-binding. Changes, errors, and typographical, printing, or calculation errors are reserved.

If a product is not available, the customer will be informed; any payments made will be refunded in this case.

4. Prices and Payment Terms

Unless otherwise stated, all prices are quoted in Swiss Francs (CHF) and include the statutory value-added tax as well as any applicable customs/tobacco duties. Additionally, the shipping costs indicated during the ordering process will be charged.

For orders with a goods value of 100.00 CHF or more, shipping may be free, provided this is indicated in the shop.

Invoices are sent exclusively via email. Unless otherwise agreed, payment is due within 15 days of invoicing.

Payment methods include PayPal, TWINT, and possibly other payment methods displayed in the shop. Snustrend may exclude certain payment methods on a case-by-case basis or restrict new/returning customers to specific payment methods.

Snustrend reserves the right to adjust prices and shipping costs at any time and to withdraw from the contract in case of typographical, printing, or calculation errors.

5. Payment Service Providers

Purchases on account (including installment payments) are processed by CembraPay AG. The GTC and privacy policy of CembraPay AG apply.

If payment service providers are used, it may be necessary to transmit personal data to them for payment processing. The processing is carried out in accordance with the respective usage and data protection regulations of the payment service provider as well as applicable data protection laws.

6. Shipping and Delivery

If stock is available, shipping usually occurs within one working day (for orders placed by 2:00 PM). The specified delivery times are non-binding and may vary.

Delivery is made to the address provided by the customer. Partial deliveries are permissible as long as they are reasonable for the customer.

Obvious transport damages must be reported immediately to the carrier and Snustrend.

7. Cancellation by the Customer (Processing Fee)

A cancellation by the customer is only possible as long as the order has not yet been shipped.

A processing fee of 2.50 CHF per cancellation initiated by the customer will be charged.

Snustrend reserves the right to cancel orders for important reasons (e.g., age doubts, payment problems, misuse).

8. Right of Withdrawal and Return Policy

Consumers have a basic right of withdrawal of 14 days for online transactions.

The right of withdrawal is excluded for snus, snuff tobacco, and other tobacco products, as these may be products with limited shelf life or perishable goods.

A return is only possible for incorrectly delivered or damaged products. In this case, Snustrend must be contacted within 48 hours of receipt.

9. Retention of Title

The delivered goods remain the property of Snustrend until full payment has been made. In case of payment default, Snustrend is entitled to withdraw from the contract and reclaim the goods.

10. Intellectual Property

Snustrend reserves all rights to the design, texts, graphics, and content of the website. Copying is only permitted for the purpose of the ordering process. Any further use requires the prior consent of Snustrend.

11. Data Protection

Snustrend processes personal data in accordance with applicable data protection regulations (especially under Swiss data protection law). Customer data is used for order processing and internal purposes.

Disclosure to third parties only occurs to the extent necessary for contract fulfillment (e.g., shipping service providers, payment providers). The customer has the right to information about the data stored about them.

12. Disclaimer

12.1 Content of the Online Offer

Snustrend does not guarantee the timeliness, accuracy, completeness, or quality of the information provided. Liability claims are excluded, unless there is intent or gross negligence and as far as legally permissible.

12.2 References and Links

Snustrend is not liable for the content of external websites that are directly or indirectly referenced, as long as Snustrend has no influence on their content and is not aware of any illegal content.

12.3 Copyright and Trademark Rights

All mentioned brands and trademarks are subject to the rights of their respective owners. Reproduction or use of content without consent is prohibited.

12.4 Misuse / Legal Guidelines for the Sale of Tobacco Products

No one under the age of 18 may order on the website. By placing an order, the customer confirms that they are at least 18 years old and will not resell tobacco products. In case of suspicion of violation or misuse, Snustrend may refuse to fulfill the order.

13. Applicable Law and Jurisdiction

These GTC and contracts based on them are subject to Swiss law, excluding the UN Sales Convention (CISG). The place of jurisdiction is St. Gallen, as far as legally permissible.

14. Final Provisions

The current version of the GTC at the time of the order applies. Deviating conditions of the customer do not apply unless Snustrend expressly agrees to their validity in writing.

Snustrend reserves the right to change these GTC at any time.

If individual provisions are or become ineffective, the validity of the remaining provisions remains unaffected.
