Disposable vapes (often referred to as "Puff Bars") are under pressure in Switzerland. Parliament wants to ban them nationwide, and several cantons are no longer waiting for Bern. With the ruling of the Federal Court in the summer of 2026, it is now clear: Cantons may issue their own sales bans. Here you will learn where things stand today, what is coming next, and what alternatives exist.

Are disposable vapes banned in Switzerland?

No, not nationwide. A national ban has been decided but not yet implemented. The motion by National Councilor Christophe Clivaz was accepted by the National Council in June 2024 with 122 to 63 votes, and by the Council of States on June 4, 2025, with 19 to 11 votes and 3 abstentions. The Federal Council must now amend the Tobacco Products Act (TabPG). So far, it has not submitted a draft law.

Until the national ban comes into effect, the cantons decide for themselves. Nationwide, it has already been in effect since October 1, 2024, that vapes may only be sold to persons aged 18 and older. What did the Federal Court decide about the Valais ban?

On July 1, 2026, the Federal Court dismissed the complaints against the Valais sales ban (rulings 2C_264/2025, 2C_290/2025, 2C_291/2025, published on July 15, 2026). The plaintiffs were the Association of Swiss Tobacco Trade, a large tobacco company, and two Valais shops.

The key points of the ruling:

  • Federal law does not conclusively regulate the sale of e-cigarettes. Cantons retain residual jurisdiction.
  • Cantons may issue additional rules for environmental protection and public health.
  • The ban is a proportionate restriction of economic freedom.
  • This applies as long as the federal government has not issued its own regulation.

The Valais ban is included in the cantonal health law (amendment of 2024) and has been in effect since May 2025. Anyone who sells disposable vapes despite this risks a penalty.

Important: The cantonal rules prohibit the sale of disposable e-cigarettes in the canton. There is no consumption ban for adults included (as of research).

Why is the ban in Geneva back in effect?

Geneva almost unanimously decided on the ban in August 2025 (Law 13'580 of August 29, 2025). On April 28, 2026, the Constitutional Chamber of the Geneva Cantonal Court lifted the ban. Their reasoning: The federal government has conclusively regulated the matter. The Geneva Grand Council referred the case to the Federal Court. This granted suspensive effect on July 16, 2026. Since then, the sales ban has been back in effect. According to the Canton of Geneva, violations can result in fines of CHF 1,000 to 40,000 and, in extreme cases, the revocation of the sales permit. The Federal Court's decision on the main issue is still pending. However, after the Valais ruling, it is foreseeable which direction it will take.

When will the national disposable vape ban come into effect?

There is no exact date yet. The Federal Council must amend the TabPG and send a draft to Parliament. According to media reports, it typically has two years for this, so approximately until mid-2027. After that, there will be a consultation, parliamentary debate, and a transition period. Therefore, a nationwide ban is realistically expected no earlier than 2028.

For comparison: In Europe, disposable vapes are already banned in Belgium (since January 2025), France (since February 2025), and the United Kingdom (since June 2025). Why should disposable vapes be banned?

Politics cites mainly two reasons:

  • Environment: Disposable vapes contain a lithium battery and electronics. In the Council of States debate, it was stated that about 90 percent are not disposed of correctly. The Federal Court explicitly supported the Valais ban based on environmental protection.
  • Youth protection: Low prices and sweet flavors are considered particularly attractive to young people. Therefore, the devices have become a political issue.

Rechargeable and refillable systems are explicitly not affected by the national motion.

What alternatives are there to disposable vapes?
